HAPI.BYTES GENERAL TERMS AND CONDITIONS
Hapi.Bytes (hereinafter referred to as “Hapi.Bytes”) provisioning of a fiber internet service (hereinafter referred to as the “Service”) shall be governed by the following terms and conditions (hereinafter referred to as the “Agreement”);
Hapi.Bytes hereby makes it clear to the Subscriber that the Service provided under this Agreement is purely for the use applied for. Hapi.Bytes reserves the right to determine if actual use is consistent with the use applied for. Any use of the Service provided contrary to what was applied for, in any form or manner whatsoever, is strictly prohibited. Hapi.Bytes reserves the right without need of demand or notice to automatically disconnect the Service provided, if the Subscriber violates the foregoing, without prejudice to forfeiting all sums received from the Subscriber and claiming additional damages in accordance with the provisions of this Agreement.
INSTALLATION FEE
The installation fee is worth One Thousand only (PHP1,000). Hapi.Bytes may offer free installation promo from time to time without proper notice.
LOCK-IN PERIOD
The Subscriber acknowledges that the service has no lock-in period, but all outstanding balances must be fully settled before any request for termination, downgrade, or account cancellation is processed.
NO DATA CAPPING
All affordable plans provided by Hapi.Bytes are powered by Fiber Internet Technology. This is the most advanced connectivity in the industry today. Hence, all plans that are being offered to the subscribers have no data capping.
ADDITIONAL INSTALLATION CHARGES
In certain instances, the Subscriber shall pay for additional charges to cover materials and labor for non-standard installations, depending on the length of the fiber optic cable and other factors.
SERVICE COMMENCEMENT DATE AND START OF BIILING
The Service shall be activated upon acceptance by the Subscriber and deemed accepted after 24 hours if no issue is raised. The activation date shall serve as the Service Commencement Date. The billing date may differ from the installation date and will be assigned upon service activation. Electronic Statements of Account will be sent to the Subscriber’s registered email address and via SMS.
PAYMENT
Hapi.Bytes shall send a monthly statement of account to the registered email address and mobile number of the subscriber. Should Subscriber fail to receive the Statement of Account for whatever reason, he agrees to call and inform Hapi.Bytes’s Customer Service Hotline + 63 9616484666. The subscriber shall fully pay any and all outstanding balance on or before the due date indicated in the statement of the account. Subscriber acknowledges that Hapi.Bytes has advised him that we may suspend the Service in case of Subscriber’s failure to pay any bill on or before the specified due date. Hapi.Bytes shall bill the Subscriber at monthly intervals but reserves the right to alter the date of billing or interval billing. Payment made by check shall not release the Subscriber from liability for non-payment until the check is cleared and payment is credited to Hapi.Bytes’s account. The Subscriber shall indemnify Hapi.Byts for any and all penalties, fees and charges arising from or by virtue of the dishonor of the Subscriber’s check. Payments may be made at any of the available payments centers that are accredited by Hapi.Bytes.
PENALTIES
Hapi.Bytes shall impose a late payment penalty of PHP150 on all disconnected accounts. The reconnection fee shall be paid upon request for reconnection.
DISCONNECTION
Subscriber agrees that Hapi.Bytes may without prior notice disconnect the Service of any Subscriber whose bill remains unpaid after the specified Due Date. Subscriber also agrees that Hapi.Bytes may temporarily suspend the Service in any of the following instances:
- Violation by Subscriber of the terms and conditions of this Agreement;
- Misrepresentation or false statement by Subscriber in the application for Service;
- Illegal connection or use of unauthorized equipment or accessories;
- Suspicious fraudulent misuse or abuse of Service, ONU and/or Peripherals;
- Unauthorized transfer of Service/location;
- Failure to notify Hapi.Bytes of change in billing address;
- Other analogous cause.
NON-TRANSFERABILITY
All Hapi.Bytes Services, the Customer Premises Equipment including any of the foregoing terms and conditions may not be leased, assigned or transferred by the Subscriber without the prior written consent of Hapi.Bytes. Any lease, assignment or transfer made without the necessary Hapi.Bytes consent shall be void and Hapi.Bytes shall have the right to continue billing the Subscriber on record liable under the pertinent terms and conditions as if no such lease, assignment or transfer was made.
TERMINATION OF SERVICE
Subscriber may terminate his subscription in writing by giving one (1) month prior notice for cancellation and by fully settling all his outstanding obligations with Hapi.Bytes up until the date of effectivity of the termination.
CHANGES TO THIS TERMS OF USE
Hapi.Bytes reserves the right to change this Terms of Use from time to time, in whole or in part, without notice to you. You should check back often so you are aware of your current rights and responsibilities. Your continued use of this website after changes to the Terms of Use have been published constitutes your binding acceptance of the updated Terms of Use. If at any time the Terms of Use are not acceptable to you, you should immediately cease all use of this website.

We may share your data with authorized personnel, third-party service providers, affiliates, or government authorities when required by law. We implement reasonable organizational, technical, and physical safeguards to protect your information and retain it only for as long as necessary to fulfill the purposes for which it was collected.
As a data subject, you have rights under the Data Privacy Act, including the right to access, correct, or request deletion of your personal data, to object to certain processing, and to file a complaint with the National Privacy Commission.
