Terms & Conditions


Hapi.Bytes (hereinafter referred to as “Hapi.Bytes”) provisioning of a fiber
internet service (hereinafter referred to as the “Service”) shall be governed by
the following terms and conditions (hereinafter referred to as the “Agreement”);
Hapi.Bytes hereby makes it clear to the Subscriber that the Service provided
under this Agreement is purely for the use applied for. Hapi.Bytes reserves the
right to determine if actual use is consistent with the use applied for. Any use
of the Service provided contrary to what was applied for, in any form or manner
whatsoever, is strictly prohibited. Hapi.Bytes reserves the right without need of
demand or notice to automatically disconnect the Service provided, if the
Subscriber violates the foregoing, without prejudice to forfeiting all sums
received from the Subscriber and claiming additional damages in accordance
with the provisions of this Agreement.
The installation fee is worth Two Thousand Pesos only (PHP 2,000).
Hapi.Bytes may offer free installation promo from time to time without proper
The Subscriber acknowledges and agrees to one (1) year lock-in period for the
service availed of such that, if he chooses to downgrade his plan or transfer to
another address where there are no available Hapi.Bytes facilities to continue
serving him of the availed service or pre-terminate or cancel his subscription
within the lock-in period, he agrees to pay the relevant pre-termination fees,
charges and penalties imposed by Hapi.Bytes.
All affordable plans provided by Hapi.Bytes are powered by Fiber Internet
Technology. This is the most advanced connectivity in the industry today.
Hence, all plans that are being offered to the subscribers has no data capping.
In certain instances, the Subscriber shall pay for additional charges to cover
materials and labor for non-standard installations, depending on the length of
the fiber optic cable and other factors.
The Service shall be activated upon acceptance by the Subscriber. The
Service is deemed accepted after 24 hours of testing, if there is no service
issue raised by the Subscriber. The day of activation shall be the Service
Commencement Date for each Service. Billing will commence on the following
day after the date of activation. Electronic Statement of Account will be sent to
Subscriber’s active email provided during the application process or such other
email address provided to Hapi.Bytes by the Subscriber, as well as via SMS.
Hapi.Bytes shall send a monthly statement of account to the registered email
address and mobile number of the subscriber. Should Subscriber fail to receive
the Statement of Account for whatever reason, he agrees to call and inform
Hapi.Bytes’s Customer Service Hotline + 63918 557 326. The subscriber shall
fully pay any and all outstanding balance on or before the due date indicated
in the statement of the account. Subscriber acknowledges that Hapi.Bytes has
advised him that we may suspend the Service in case of Subscriber’s failure to
pay any bill on or before the specified due date. Hapi.Bytes shall bill the
Subscriber at monthly intervals but reserves the right to alter the date of billing
or interval billing. Payment made by check shall not release the Subscriber
from liability for non-payment until the check is cleared and payment is credited
to Hapi.Bytes’s account. The Subscriber shall indemnify Hapi.Byts for any and
all penalties, fees and charges arising from or by virtue of the dishonor of the
Subscriber’s check. Payments may be made at any of the available payments
centers that are accredited by Hapi.Bytes.

Hapi.Bytes shall charge late payment penalty equivalent to 5% per month for
all accounts not paid by the Due Date. In determining the penalty, a fraction of
a month shall be considered as one (1) month.

Subscriber agrees that Hapi.Bytes may without prior notice disconnect the
Service of any Subscriber whose bill remains unpaid after the specified Due
Date. Subscriber also agrees that Hapi.Bytes may temporarily suspend the
Service in any of the following instances:
ï Violation by Subscriber of the terms and conditions of this Agreement;
ï Misrepresentation or false statement by Subscriber in the application for
ï Illegal connection or use of unauthorized equipment or accessories;
ï Suspicious fraudulent misuse or abuse of Service, ONU and/or Peripherals;
ï Unauthorized transfer of Service/location;
ï Failure to notify Hapi.Bytes of change in billing address;
ï Other analogous cause.

All Hapi.Bytes Services, the Customer Premises Equipment including any of
the foregoing terms and conditions may not be leased, assigned or transferred
by the Subscriber without the prior written consent of Hapi.Bytes. Any lease,
assignment or transfer made without the necessary Hapi.Bytes consent shall
be void and Hapi.Bytes shall have the right to continue billing the Subscriber
on record liable under the pertinent terms and conditions as if no such lease,
assignment or transfer was made.

Subscriber may terminate his subscription in writing by giving one (1) month
prior notice for cancellation and by fully settling all his outstanding obligations
with Hapi.Bytes up until the date of effectivity of the termination. If termination
is made during the lock-in period, Subscriber shall pay a pre-termination fee in
the amount of the full Monthly Service Fee multiplied by the number of the
months remaining in the lock-in period or in such amount as may be prescribed
by Hapi.Bytes from time to time in its sole but reasonable discretion upon prior
written notice to all subscribers , as well as the Subscriber’s pro-rated bill. In
determining the unexpired period, a fraction of a month shall be considered as
one (1) month. Subscriber shall also pay the permanent disconnection fee
prevailing at the time of disconnection.
Hapi.Bytes reserves the right to change this Terms of Use from time to time, in
whole or in part, without notice to you. You should check back often so you are
aware of your current rights and responsibilities. Your continued use of this
website after changes to the Terms of Use have been published constitutes
your binding acceptance of the updated Terms of Use. If at any time the Terms
of Use are not acceptable to you, you should immediately cease all use of this


As a condition for use of the service, you permit Hapi.Bytes and its subsidiar-
ies, affiliates, and subcontractors to process and/or disclose personal data,

including data that may be classified as personal information and/or sensitive

personal information under the Data Privacy Act of 2012, to agents, subsidiar-
ies, affiliates, partners, and other third parties, in order to undertake activities

that may include, among others:
ï Conducting analysis for purposes of research and marketing initiatives,
including the generation of anonymized or non-personally identifiable
location and mobility data to show footfall, location patterns, crowd density,
and other information that may be relevant for marketing purposes;
ï Managing your account, providing customer care activities, monitoring the
quality and security of the network, training our staff, providing the services
to you in a timely and efficient manner, and ensuring your fair and lawful use
of the products and services provided by Hapi.Bytes;
ï Generating statistical insights based on usage/network information to assist
the Government in planning for healthcare, disaster, and other similar

ï Credit scoring programs and initiatives, including but not limited to providing
information to the Credit Information Corporation in furtherance of the
objectives of Republic Act No. 9501, otherwise known as the Credit
Information System Act;
ï Sending commercial and promotional advertisements, loyalty and rewards
offers, surveys, customer-care, and after sales communications, and other
broadcast push messages;
ï Sharing your personal data with third-party content providers or other
third-party ser vices for which you sign up; and
ï Such other processing or disclosure that may be required under law or
Your personal data will be maintained in our records throughout your availment
of the service, and for a maximum period of seven years thereafter. You are
afforded certain rights in relation to your personal data under the Data Privacy
Act, including the right to object to processing, the right to access your data,
the right to rectification of inaccurate data, and the right to erasure or blocking
of data.
